PAI Medina Llíber: an eco-residential project backed by the courts

The Medina Llíber Plan is not just another residential project: it is an eco-residential development conceived under sustainability criteria and respect for the natural environment, fully compliant with all legal and environmental requirements.

On June 17, the Contentious-Administrative Court No. 2 of Alicante issued Ruling No. 245/2025, dismissing in full the appeals filed by the Town Halls of Xaló and Alcalalí against the plenary agreement of the Llíber Town Hall that approved the PAI of the Medina Sector and granted the status of urban developer to the company GARSIVA S.L.U.

This ruling reaffirms what we have always maintained: that the Medina Llíber Plan is a legal, sustainable, and beneficial project for the municipality. With this decision, it is now crystal clear that we have full legal certainty to continue developing an eco-residential complex that will bring new homes, green areas, and modern infrastructure to the Marina Alta.

The court ruling is clear:
“The Integrated Action Programme of the MEDINA Sector in Llíber does not entail new demands for water resources within the terms of Article 25 of the TRLA. Therefore, its approval does not require a report on the sufficiency of water resources.”

Furthermore, regarding the validity of the Environmental Impact Declaration, the judgment concludes:
“During the processing of the Medina Llíber Partial Plan, a favourable Environmental Impact Declaration was obtained on March 21, 2000.”

Regarding the sewerage system, the ruling confirms that:
“The urbanisation project of the Medina Llíber Sector does include a sewerage system and the connection of the sewerage system to the treatment plant, which is being carried out independently.”

Consequently, the Court concludes:
“The contentious-administrative appeal must be dismissed… the grounds listed in Article 125.1 a) and/or b) of Law 39/2015 do not apply.”
